David Robertson wants the trash and debris near his mother's grave in Floral Hills removed.
Last year, Ohio Attorney General Mike DeWine announced a lawsuit against the owners of Floral Hills Memory Gardens, Ronald Downey and Joseph Miller, for failure to deliver grave markers. Since then, a motion for summary judgment has been filed and is awaiting a judge's ruling; meanwhile, the cemetery does not appear to have been maintained.
The A.G.'s office says they have received 160 complaints thus far on Floral Hills Memory Gardens, as they have been waiting for the judge's order since February 25th.
David Robertson recently visited his mother's and uncle's graves and was shocked at condition of the grounds.
"I want the trash barrels emptied," he said. "I want this 30-foot-round pile of trash where they've been dumping for the last year cleaned up."
He also wants to see the scattered burial vaults picked up and the graves that have sunk to be covered with top soil and grass seed.
Robertson said he's contacted various officials, including the Attorney General, Ross County Prosecutor's Office, Chillicothe Law Director, Ross County Sheriff's Office, and the Huntington Township Trustees, but no one has been able to have an answer on how to make sure the grounds are maintained until the judge makes a ruling.
"Huntington Township doesn't want to do it because they don't have the money," said Robertson. "I understand that, but that's my mom's grave out there."
Robertson, however, has decided to take matters into his own hands by organizing a community effort to clean up the cemetery at 8am on April 27th, something he was told could get him into trouble (for trespassing and theft for removing the trash).
"If they want to try to come after me and arrest me, then bring it on," said Robertson.
He explained that he and others who are facing the same frustrations just want to see their loved ones' resting place taken care of, and they are going to take a stand for the deceased.
"I'm bringing 200 of my closest Facebook friends, and we're going to fix this."
Floral Hills is located at 4284 US 23 S. in Chillicothe; although, there is another Floral Hills located along Little Walnut Road in Circleville.
